Contents15 sections, 186 entries

This is an interim result of analytical work on identifying and describing the various groups of personal data processed by operators to achieve the relevant purposes. The content of the catalogue is regularly updated and expanded. By some estimates, the catalogue currently lists no more than 60% of the total number of groups of personal data processed by various operators.

The need for such work is dictated by the following reasons:

  1. The concept of personal data, set out in Art. 3(1) of Federal Law No. 152-FZ of 27.07.2006 "On Personal Data", can be interpreted extremely broadly, while the current legislation of the Russian Federation contains neither a systematised list of categories of personal data nor normatively fixed rules for determining the list of personal data. Thus, the actual implementation of the principle of formal certainty1) in relation to the normatively fixed concept of "personal data" is called into question.
  2. The existing case law is fragmented and contradictory, since the definition of the concept of "personal data" and the identification of specific categories of personal data are, in the overwhelming majority of cases, not the main subject of consideration for participants in court proceedings.
  3. Widely used wordings of particular categories of personal data are general and/or not fully elaborated, which prevents all participants in legal relations in the field of personal data from properly understanding them and also makes it impossible to match an individual category of personal data unambiguously with a specific set of information2).

According to Russian legislation, personal data is any information relating to a directly or indirectly identified or identifiable natural person (data subject). On the basis of such information a person can either be identified precisely (a "directly identified" person), or it is possible to identify the person with the use of other data (an "indirectly identifiable" person). Identification of a person takes place where the relevant information is correlated with the person's surname, first name and patronymic (if any). It is this information that is the main identifier of a citizen in civil circulation, since a citizen acquires and exercises rights and duties under their own name (Art. 19(1) of the Civil Code).

Indirect identification of a natural person implies the possibility of treating as personal data information that, although in itself it does not unambiguously point to the name of a specific person, contains a description of some of their individual characteristics that make it possible to distinguish them from other subjects, single them out from the circle of persons to which they belong or at least narrow that circle. For example, a person can be indirectly identified on the basis of traffic data (metadata), in particular information about established connections stating the time and duration of the connection and the numbers or IP addresses of the devices taking part in the communication. Thus, if data makes it possible to single out an individual from a multitude of persons and to apply a special model of interaction to them, that person is identifiable, and the relevant information is their personal data.

67) See Art. 2 of Law 86-FZ of 05.07.1996 "On State Regulation in the Field of Genetic Engineering Activities". This is in effect the result of a molecular genetic study as a whole, including chemical (essentially epigenetic) modifications. By its content such a dataset reveals predispositions, health and origin, so its "natural" place in the taxonomy of Law 152-FZ is closer to special categories (Art. 10, "health status") than to biometrics. Indirect confirmation is that Law 86-FZ itself, when describing population studies, groups people by the characteristics "nationality" and "health status", which are already special categories in themselves. In other words, Law 86-FZ does not requalify the data but introduces a transfer regime: under Arts. 13.1-13.2 cross-border transfer is permitted only for narrow purposes (helping a specific patient, developing medicinal products/biomedical cell products for a specific patient, international cooperation), while data from population studies may, as a general rule, not be transferred to foreign persons. That is, Law 86-FZ works on top of Law 152-FZ, not within its classification.
70) See Art. 9.1 of Law 86-FZ of 10.07.2002 "On the Central Bank of the Russian Federation (Bank of Russia)".
71) Deprivation of parental rights, removal of a guardian or curator from performing their duties, annulment of adoption (in the case of culpable unlawful conduct by the adopter).
72) The legal status of a person arising from conviction and the imposition by a court sentence of punishment for a crime committed, which entails the legal consequences established by criminal legislation if that person commits a further crime. Information on criminal records and criminal prosecution is specified in items 74.3, 74.4, 74.7 and 74.8 of Order No. 1121 of the Ministry of Internal Affairs of Russia of 07.11.2011.
